These Terms and Conditions constitute a legally binding agreement made between you,
\nwhether personally or on behalf of an entity (\u201ccustomer\u201d, \u201cyou\u201d) and Bin Bath, LLC (\u201cBin
\nBath\u201d, \u201ccompany\u201d, \u201cwe\u201d, \u201cus\u201d, or \u201cour\u201d) as an authorized user of such services provided
\nby the company and any of its subsidiaries.<\/p>\n
These Terms and Conditions, together with any operating rules, policies, price
\nschedules, or other supplemental documents expressly incorporated herein by
\nreference and published from time to time by Bin Bath (collectively, the \u201cAgreement\u201d),
\nconstitutes the entire agreement between Bin Bath and you regarding the bin cleaning
\nservice. By using the service, you confirm your acceptance of, and agree to be bound
\nby, this Agreement.<\/p>\n
These Terms and Conditions constitute a legally binding agreement concerning your
\naccess to and use of the\u00a0http:\/\/www.binbath.com\u00a0website as well as any other media
\nform, media channel, mobile website or mobile application related, linked, or otherwise
\nconnected thereto (collectively, the \u201cSite\u201d). You agree that by accessing the Site, you
\nhave read, understood, and agreed to be bound by all of these Terms and Conditions.\u200b

\n1. Service
\nBin Bath provides a mobile waste bin cleaning service for residential trash bins.
\nResidential service will be performed and billed on a subscription basis.
\nCustomers will not be charged until service has been performed.<\/p>\n
2. Customer Responsibilities
\nIn order for Bin Bath to provide its services, the customer must abide by the
\nfollowing conditions, or service could be interrupted or postponed, or cancelled.
\n\u200b\u200b\u200b<\/p>\n
\uf0b7 Trash bin(s) must be empty and available by the curb or alley. \u00a0If
\ncustomer lives in a gated community or property, the code must be
\nprovided and customer will hold Bin Bath harmless and release Bin
\nBath of any\u00a0damages\u00a0or\u00a0liability\u00a0to any and all surrounding property.
\nIf customer invites Bin Bath onto the customer's property or inside
\nthe\u00a0garage, then customer is responsible for all damages and
\nreleases Bin Bath from all liability.
\n\uf0b7 Trash bin(s) must be free of all trash and animal waste.\u00a0 Bins
\ncontaining unbagged feces will not be cleaned.
\n\uf0b7 Trash bin(s) must be free of chemicals, oils, any petroleum-based
\nproducts, oil-based paint, glue or other adhesive, or hazardous waste
\nof any kind.\u00a0 Bins containing these substances will not be cleaned.
\n\uf0b7 Trash bin(s) must be free of building materials, e.g. plaster, stucco or
\nconcrete.\u00a0 Bins containing these substances will not be cleaned.
\n\uf0b7 A temporary pause (vacation hold) may be placed on service.\u00a0 The
\ncustomer must notify Bin Bath by phone, email or text\u00a07 days before
\nscheduled service.\u00a0 The service will be temporarily suspended, and<\/p>\n
the customer will not be charged until service resumes on the agreed
\nupon date.
\n\uf0b7 Bin Bath will not clean damaged bins.\u00a0 A picture may be sent to the
\ncustomer via email and\/or text with a recommendation to replace.<\/p>\n
If any of the above conditions are not met, Bin Bath will not perform the service(s)
\nand the customer is still responsible for payment.\u00a0 If Bin Bath was not able to
\nperform the service, a picture may be sent to the customer via email and\/or text
\nwith an explanation.<\/p>\n
Additionally, the customer understands that Bin Bath will make every effort to get
\nall debris out of the bins, but certain substances require several treatments to be
\ncompletely removed.\u00a0 Certain substances are permanent, and some stains can
\nnot be removed.<\/p>\n
Customer will allow Bin Bath to utilize driveway for cleaning process when
\nnecessary for safety reasons.\u00a0 Bin Bath will refuse to work on certain roads that
\npresent a danger to employees or assets.\u00a0 The customer\u2019s driveway may be
\nutilized in certain circumstances, and the customer releases Bin Bath from any
\nand all damages.<\/p>\n
Customer assumes all responsibility for condition of the bin when not actively
\nbeing cleaned by Bin Bath or it\u2019s associates.\u00a0 Customer understands that some
\noverspray may occur during cleaning process and releases Bin Bath from any
\nresponsibility of damages to property.<\/p>\n
Customer may request a rescheduled appointment in the event they are not able
\nto get bins outside for service.\u00a0 Multiple reschedule requests may be denied and a
\ncharge may apply to customer\u2019s account in the amount of service.
\n\u200b
\nIt is customer's\u00a0responsibility\u00a0to make their empty bins available to be cleaned.
\nService notifications are sent out multiple times in advance via email and\/or text
\nmessage. \u00a0If Bin Bath does not receive any email, text or phone response to
\nreschedule and shows up to find no bins, full bins, or bins that are not able to be
\ncleaned due to reasons stated above, the customer is subject to a $20 reschedule
\nfee.<\/p>\n
3. Bin Bath Responsibilities
\nBin Bath will schedule the customer\u2019s service on a pre-planned route and notify
\nthe customer leading up to the day of service via email and\/or text message.\u00a0 Bin
\nBath will attempt to service all bins on its pre-planned route.\u00a0 Once the customer\u2019s
\nbins have been serviced, the customer will be charged.\u00a0 The invoice will be paid
\nby credit on file, or by charging the client\u2019s stored credit card.\u00a0 A receipt will be
\nsent by email to the customer.
\nFrom time to time, Bin Bath may service bins before trash\/recycling has been
\npicked up.\u00a0 In this case, the technician may choose to bag up any
\ntrash\/recyclables from the bins into a new clean heavy duty bag.\u00a0 The bins will be
\ncleaned, and the clean trash bag may be reinserted into the clean bins to then be
\npicked up by the customer\u2019s waste hauler.<\/p>\n
If Bin Bath is unable to provide its service(s) on the scheduled day due to
\ninclement weather, vehicle maintenance, unforeseen events or otherwise, it will
\nmake every attempt to notify the customer in advance and reschedule the
\ncustomer to the next available opportunity.\u00a0 Due to route scheduling conflicts
\nand\/or extended inclement weather, the service visit may be cancelled until the
\nfollowing scheduled service date.\u00a0 The customer will not be charged if service
\ncannot be performed due to inclement weather or vehicle maintenance.
\n\u200b
\nWinter Weather Policy:\u00a0 Bin Bath's first priority is the safety of our customers and
\ntheir property, our employees, and our equipment.\u00a0 At times that will include
\ncancelling appointments due to inclement weather conditions.\u00a0 Bin Bath will
\nattempt to reschedule, but sometimes that may not be possible and a cancellation
\nof that service visit may occur.\u00a0 In the event of a cancellation, a subscription client
\nmay have to wait until the next scheduled cleaning visit for service.\u00a0 At times Bin
\nBath may not be able to clean the exterior of the bins due to excess water
\noverspray.\u00a0 The inside will still be cleaned, sanitized and deodorized, and the
\nmajority of the wastewater will be collected on the truck.\u00a0 Company policy is that
\nthe client will not be charged unless service has been completed.\u00a0 In the event of
\na cancellation or reschedule due to weather, the client will be notified via email
\nand\/or text.\u00a0 Bin Bath will not be held responsible for frozen water left behind from
\nthe cleaning process and the client hereby releases Bin Bath from any liability.<\/p>\n
4. Charges
\nThe customer agrees to pay all charges for the service(s) and any applicable
\ntaxes.\u00a0 Bin Bath reserves the right to adjust pricing at any time.\u00a0 Changes in
\npricing may be communicated to the customer via updates to the website and\/or
\nemail.\u00a0 It is the customer\u2019s right to choose to continue or discontinue the service at
\nany time.\u00a0 The service will continue on a recurring basis until cancelled by the
\ncustomer.\u00a0 Customers may request a change to the selected service plan 7 days
\nin advance of the next scheduled service.<\/p>\n
Service Based Payment (Pay as you go):<\/p>\n
\uf0b7 Customer must have a Debit Card or Credit Card stored on file, and
\nhave accepted automatic future charges.
\n\uf0b7 Customer will be billed\/charged after each completed service visit.
\n\uf0b7 Customer is responsible for paying for the service requested
\nregardless of the number of bins present and available for cleaning.
\n\uf0b7 An invoice is created after each service.
\n\uf0b7 Payment is automatically collected after each service.
\n\uf0b7 A receipt will be sent to the customer via email after each service.
\n\uf0b7 Service is ongoing until customer cancels service.<\/p>\n
Pre-Payment:<\/p>\n
\uf0b7 Customer must have a Debit Card or Credit Card stored on file, and
\nhave accepted automatic future charges.
\n\uf0b7 Pre-Payment charges will be made in advance of the first cleaning.
\n\uf0b7 Customer\u2019s account will maintain a credit that will be drawn down
\nafter each service visit until depleted.
\n\uf0b7 Customer is responsible for paying for the service requested
\nregardless of the number of bins present and available for cleaning.
\n\uf0b7 A receipt will be sent to the customer via email after each service to
\nkeep customer informed of current balance available on account.
\n\uf0b7 Once customer\u2019s account is depleted, Bin Bath will automatically
\ncharge the customers for another 12 month period of service, or
\nconvert the customer to pay as you go for same service interval.\u00a0 A
\npricing adjustment may be necessary.
\n\uf0b7 Service is ongoing until the customer cancels service.<\/p>\n
Bin Bath will utilize industry leaders in payment processing to safely and securely
\nstore customer\u2019s credit card information.\u00a0 Customer\u2019s card will be run
\nautomatically after service, and a receipt will be sent via email.<\/p>\n
5. Referral Program
\nExisting subscription customers in good standing may be eligible to receive a
\nreferral fee for referring a new first time paying subscription customer.\u00a0 Existing
\ncustomer will forfeit the free cleaning credits if they cancel their existing
\nsubscription after receiving free cleaning credits before utilizing the free cleaning
\ncredit.\u00a0 If the existing customer cancels subscription after utilizing the free cleaning
\ncredits but before paying for another subscription cleaning, they are subject to a
\ncharge for each cleaning that was free (equal to the subscription price).\u00a0 Bin Bath
\nreserves the right to terminate the Referral Program at any time.<\/p>\n
6. Modifications to Terms and Conditions and\/or Customer Agreement
\nBin Bath reserves the right to modify and\/or amend the Terms and Conditions
\nand\/or the Customer Agreement at any time by posting a revised Terms and
\nConditions and\/or the Customer Agreement at\u00a0www.binbath.com, and\/or sending
\ninformation regarding the amendment to the email address you provided to Bin
\nBath.<\/p>\n
7. Modifications to Service
\nBin Bath reserves the right to modify the service at any time for the betterment of
\nour customers and the overall success of the service program.\u00a0 Customer may
\nadjust service frequency at any time and will accept the price difference to do so.<\/p>\n
8. Default Payments
\nBin Bath reserves the right to suspend or terminate your service without notice
\nupon rejection of any credit or debit card charges, or if the customer\u2019s card issuer<\/p>\n
(or its agent or affiliate) seeks return of payments previously made to Bin Bath.
\nSuch rights are in addition to and not in lieu of any other legal rights or remedies
\navailable to Bin Bath.<\/p>\n
9. Cancellation of Subscription Service
\nThe customer may cancel a subscription service at any time.\u00a0 If subscription
\ncancellation occurs after only one cleaning visit, the customer will be charged the
\nminimum service fee which is the equivalent of the One Time Cleaning Rate for
\nthe number of bins cleaned.\u00a0 Cancellation must occur 14 days in advance of next
\nscheduled service date.\u00a0 Pre-payment refunds are not issued for cancellation of
\nservice.<\/p>\n
10. Customer Information
\nWe do not sell, trade, or rent customer\u2019s personal identification information to
\nothers.\u00a0 Bin Bath utilizes industry leading PCI compliant credit card information
\nstorage through their payment processor.
\n\u200b
\n11. Sanitization and Disinfection
\nThe customer understands that Bin Bath's high pressure hot water is a great
\ndefense against germs and the environments they thrive in, but that Bin Bath can
\nnot guarantee the complete elimination of all contagions within, around and on
\ngarbage bins.\u00a0 Bin Bath will make all reasonable efforts to sanitize and disinfect to
\nthe best of their ability, but makes no claims to prevent disease and\/or the spread
